Welcome to EchoSpace. These Terms of Service ("Terms") are a binding agreement between you and EchoSpace, Inc. ("EchoSpace", "we", "us") governing your use of the EchoSpace iOS and Android apps and related services (collectively, the "Service"). By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (16 in the EEA, or the digital-consent age in your country) to use EchoSpace. If you are under the age of majority where you live, you must have a parent or guardian's consent. You are responsible for the activity on your account and for keeping your device and credentials secure.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Service for your own non-commercial use. You may not sublicense, resell, rent, reverse-engineer (except where permitted by law), or use the Service to build a competing product.
You own everything you create in EchoSpace — your messages, journal entries, AR scenes, voice notes, and uploaded photos ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, process, and display Your Content solely to operate the Service for you. This license ends when you delete the content or your account.
We do not use Your Content to train any AI model.

The Service — including software, design, brand, and "EchoSpace" name and logo — is owned by EchoSpace, Inc. and protected by intellectual-property laws. Except for the limited license in Section 2, no rights are transferred to you.
The Service integrates third-party platforms (Apple, Google, RevenueCat, Supabase, AI providers, Apple Health). Your use of those features is also subject to their terms. We are not responsible for third-party services beyond our reasonable diligence in selecting them.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT AI OUTPUT WILL BE ACCURATE. NOTHING IN THESE TERMS LIMITS RIGHTS YOU HAVE AS A CONSUMER UNDER MANDATORY LOCAL LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHOSPACE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY APPLY TO THE EXTENT PERMITTED.
You agree to indemnify and hold EchoSpace harmless from any claim arising from your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.
You can stop using the Service at any time. We can suspend or terminate access if you breach these Terms or to comply with law. Sections that by their nature should survive termination (IP, disclaimers, liability, governing law) will survive.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved by binding arbitration on an individual basis in San Francisco, California, under the AAA Consumer Arbitration Rules, except that either party may bring a small-claims action. You waive the right to participate in a class action. EU/UK consumers retain the right to bring claims in their home courts under mandatory local law.
If you obtained the Service from the Apple App Store, the following apply. These Terms are between you and EchoSpace only — Apple is not a party. Apple is not responsible for the Service or its content. To the maximum extent permitted, Apple has no warranty or product-liability obligations. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not on any US Government list of prohibited or restricted parties.
If you obtained the Service from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the Service.
We may update these Terms. Material changes will be announced in-app and by updating the "Last updated" date. Continued use after the effective date constitutes acceptance.
